The General Conditions of Contract regulate the online sales relationship between the holder and the user or client, in accordance with the legal stipulations, especially Law 7/1998, of April 13, on General Conditions of Contracting, Law 3/2014, of March 27, which amends the consolidated text of the General Law for the Defense of Consumers and Users, Royal Decree 1906/1999, of December 17, 1999, regulating Telephone or Electronic Contracting with general conditions, Organic Law 15/1999, of December 13, on the Protection of Personal Data, Law 7/1996, of January 15, on Retail Trade Regulation, and Law 34/2002 of July 11, on Information Society Services and Electronic Commerce. The holder reserves the right to make modifications that it deems appropriate to adapt them to current regulations and their changes in the General Conditions. Such modifications may be made through its website, by any legally admissible means, and will be mandatory for the duration they are published on the web until they are validly modified by subsequent ones.

The purpose of the website is to provide advisory and management services, such as training, filling out forms, supporting the client in their legal procedures in Spain, etc. The duration of the contract will be linked to the completion of the contracted service. As a user or client, you expressly declare that you know, understand, and accept the terms of use and these general contracting conditions. The services offered in our online store include basic advisory or management services. All services indicate the selling price in Euros and include Value Added Tax (VAT). If any other tax is applicable, it will be indicated beforehand and charged in the invoice.

6. Payment methods and service execution

Payment is made through an external virtual POS system belonging to a collaborating bank (Banc Sabadell), which determines the accepted credit cards as well as the data required from the client to make the payment. The client can pay the amount for their service usually opting for any of the following methods. During the purchase process, they must indicate their choice: Credit card VISA or MASTERCARD. All operations involving the transmission of personal or banking data are carried out using a secure environment, a server based on standard SSL (Secure Sockets Layer) security technology. All information transmitted to us travels encrypted over the network. Likewise, the data about your credit card is entered directly on the bank's page, in the Bank’s POS (Point of Sale Terminal) and is not entered or registered on any server of the holder. When paying with a VISA or MASTERCARD card, the following data will always be requested: the card number, the expiration date, and a Validation Code that matches the last 3 digits of the number printed in italics on the back of your VISA or MASTERCARD card, thus offering more guarantees regarding the security of the transaction. This payment method is only valid on the web. When the amount of a purchase has been charged fraudulently or improperly using a payment card number, its holder may demand the immediate cancellation of the charge. In such cases, the corresponding debit and refund entries in the accounts of the provider and the holder will be made as soon as possible. However, if the purchase was indeed made by the cardholder and the demand for refund was not a result of exercising the right of withdrawal or resolution and, therefore, improperly demanded the cancellation of the corresponding charge, the latter will be obliged to the holder to compensate for the damages caused as a result of that cancellation.

7. Right of withdrawal, return, and claims

According to the provisions of Article 103 of Law 3/2014, of March 27, which amends the consolidated text of the General Law for the Defense of Consumers and Users, the supply of services or goods made according to the specifications of the consumer or clearly personalized, or that, by their nature, cannot be returned or may deteriorate or expire quickly, are exempt from withdrawal.

Returns: The user has the right to a full refund of the amount paid for the service, provided that the conditions of the cancellation policy are met. The refund will be made through the same payment method used for the purchase, in this case, through the virtual POS, once all data has been verified within 24 hours.

8. Applicable law and jurisdiction

The relationship between the holder and the client will be governed by Spanish law. The parties submit, at their choice, for the resolution of conflicts and waiving any other jurisdiction, to the courts and tribunals of the address of the holder, unless the law provides otherwise.

9. Cancellation

Cancellations are possible as long as they are detailed and submitted in writing to info@incwell.eu at least one week prior to the service, provided that the following two conditions are met: 1- the service or management has not begun, and 2- no payments of any kind have been made for the client (for example, notary fees or taxes). Cancellations communicated by any other means will not be accepted. This email must include all purchase details, including full name, date, and contact information. If notary fees, shipping, taxes, or any other expenses related to the client have been incurred, the client must cover these expenses even if they cancel the management or advice, plus €120 for cancellation processing fees.

10. Use of the website. User and legal liability regime

Navigation, access, and use of the holder's website grants the status of user, by which all the terms of use established herein are accepted, without prejudice to the application of the corresponding legally binding regulations as applicable. The holder's website provides a wide variety of information, services, and data. The user assumes responsibility for the correct use of the website. This responsibility extends to: 1.- The truthfulness and legality of the information provided by the user in the forms provided by the holder to access certain content or services offered on the website. 2.- The use, misuse, or misunderstanding of the information, services, and data offered by the holder, contrary to the provisions of these conditions, the Law, morality, good customs, or public order, or that may otherwise cause harm to the rights of third parties or the proper functioning of the website.

Likewise, it does not guarantee the technical availability, accuracy, truthfulness, validity, or legality of external sites that may be accessed through the links. The holder declares to have taken all necessary measures to prevent any damage to users of its website that may arise from browsing its website. Consequently, the holder is not responsible for any possible damages that the user may suffer from browsing the Internet.

12. Online service contracts

The advisory and management services explained on the holder's website can be contracted online. The use of these services will require reading and mandatory acceptance of the general contracting conditions established for this purpose by the holder.

13. Intellectual and industrial property

The holder, either directly or as assignee, owns all intellectual and industrial property rights of its website, as well as the elements contained therein (including, but not limited to, images, sound, audio, video, software, or texts; brands or logos, color combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.), are owned by the holder. Consequently, they will be protected works as intellectual property under Spanish law, being applicable both Spanish and EU regulations in this field, as well as international treaties related to the subject matter signed by Spain, EU regulations, and California state laws on IP. Should any controversy arise, the parties declare to submit their conflicts to mediation. If it becomes necessary to resort to ordinary jurisdiction, it will comply with the rules regarding jurisdiction and competence in this regard.
